Compliance is an ongoing effort..24/7

The operation of the compliance program will be driven by BCA.
Your single responsibility is to provide Employee census data on each new employee (name, birth date, address etc.) and BCA takes over from there.



Eligibility and Employee Data Collection:

BCA Operations will process the individual employee data on a 24/7 basis and make sure that all compliance requirements are met on an ongoing basis and determine

1. Is the employee Eligible for the individual mandate?

2. Do they participate/or waive participation in the employer’s coverage?

3. Is the employee Eligible to purchase coverage from the Connector?

4. Is the employee Eligible to participate in the Employers new Cafeteria Sec. 125 Plan?
5. Have they elected/waived to be a member of the new Cafeteria Plan?

6. Must they complete a HIRD form?

Providing employee data is the primary employer responsibility. It is a simple process that takes about 2 minutes per employee.




Hird Process

Each employee has a kit mailed to their home with information about compliance, including a 2 part HIRD form and a post paid envelope that they must return to BCA.
BCA will scan and store these forms for three years and make copies available to the employee and state regulatory agencies as required.

Define Payroll deduction process

for the members of the Cafeteria Plan that request this service. Enable client payroll to accept payroll deduction amounts and send the resulting deductions and payments to the Connector.

Reporting:

BCA will provide web access to the Portal that enables activity based reports. You will be able to see the employee data you entered, the HIRD forms sent and received from the employee as a scanned image.

Annual Enrolment:

As required by the Federal Cafeteria Plan rules , each eligible employee will be given the opportunity to enroll or waive the Sec. 125 plan. BCA will provide each employee with the enrollment materials as well as the HIRD forms that must be held by the employer.

Connector:

Communications and eligibility BCA will provide a data feed of all of your eligible employees and their eligibility dates to the Connector as required by law

Other Services:

BCA will provide all process consulting and if requested Legal review of the entire process. This may entail some extra charges for the legal review; which will be presented and accepted by the client before we begin the process.
