What must employers do to be in Compliance with the Massachusetts Chapter 58 Regulations?
To satisfy these new mandates employers must develop a compliance process to identify those Massachusetts employees that are subject to the new regulations and then determine if they need to complete and return a Health Insurance Responsibility Determination ("HIRD") Form. These employees must complete a HIRD Form.
- Employees that are eligible but waive the employer's health plan
- Employees that are *NOT* eligible for the employer's health plan

Connector:
Communications and eligibility, BCA will provide a data feed of all of your eligible employees and their eligibility dates to the Connector as required by law.
Reporting:
The software will provide web access to the Portal that enables activity based reports. You will be able to see the employee data you entered, the HIRD forms sent and received from the employee as a scanned image.
Annual Enrolment:
As required by the Federal Cafeteria Plan rules, each eligible employee will be given the opportunity to enroll or waive the Sec. 125 plan. BCA will provide each employee with the enrollment materials as well as the HIRD forms that must be held by the employer.
Exemptions
An Employer is not a Non-Providing Employer if it is a signatory to or obligated under a negotiated, bona fide collective bargaining agreement that governs the employment conditions of the State-Funded Employee (an employee that access the UCP); or
Employer participates in the Insurance Partnership Program.
