Why do you need to comply?

First and foremost, its now the Law in Massachusetts.

Second, the penalties for ignoring the law can be significant.

Penalties ranging from a "free rider" surcharges in the tens thousands of dollars to possible civil penalty of not more than $5,000 for each week on which certain reporting violation occurs or continues have been legislated. While these measures will be the exception not the rule; why take a chance on non-compliance? With the electronic filing requirements enforcement is certain.
    The Massachusetts Taxpayers Foundation Report( December 2007) urges compliance and notes "....a high level of compliance is expected. Small companies, in particular, may need to develop or purchase new legal, human resource and payroll services in order to comply."

The ComplyPRO eXpress Concierge Subscription is a complete full service outsourced approach where BCA operates the software and provides all of the service and support. With this turnkey approach clients interact with the Complete Comply Concierge, the PRO, who manages their activity. The ComplyPRO eXpress Software only Subscription is a self-service approach where the user is able to operate the Complete Comply™ system on their own, all the while being guided by an online software wizard. With either approach an employer can be assured that they are in complete compliance in all the jurisdictions where they operate. Both options use the same Complete Comply™ Platform to deliver services, the only difference is how the client chooses to interact with the platform.

How do these approaches differ?

Each approach uses the same Complete Comply™ platform so an employer can be assured that they are in Complete Compliance in those jurisdictions that require Healthcare compliance. The major difference is cost, the ComplyeXpress Subscription is a self service approach that can save the average employer $500 to $1,000 per year. With self service the user has more direct control over the process and more direct responsibility. This will require more work on the clients part (most likely less than an hour a month.) With ComplyPRO full service approach, the PRO assigned to your case handles the entire effort on a turnkey basis, meaning less work for the user, but at a slightly higher cost.

What approach is best for my organization?

If your time is short and you do not normally handle these compliance matters, or simply wish to have an expert do the job for you, the Full Service approach with ComplyPRO may be best for you. Why don't employers do this all themselves?

Many do, and in fact the Mass Connector has provided many useful resources that can be used to "Do it yourself". Here is a link to the 'Connector Employer Manual.'

The process can be complex and most employers do not have the time and resources to handle compliance. Compliance is a popular and natural task to outsource. Employers are familiar with ERISA compliance which sets a level playing field across all 50 states Many employers do not have the expertise and experience and are not ready to “localize compliance and communication”. Since each state and local jurisdiction is unique, just keeping up with the rapidly changing laws, regulations, support structures and reporting requirements can be an expensive and time consuming task.
